Treasury proposes broader limits and reporting rules for outbound investment in strategic technologies

The Treasury Department proposed regulations implementing the COINS Act, expanding the U.S. outbound-investment program. The proposal would require notifications for some transactions and prohibit others involving covered foreign persons and sensitive technologies, including artificial intelligence, semiconductors, quantum information, high-performance computing, hypersonics and biotechnology. It also outlines definitions, exceptions, diligence expectations and penalties. The rules are not final: Treasury is soliciting comments and will later issue implementing regulations that establish the program’s effective date.
